Terms & Conditions
Last updated 27 Sept 2026
These Terms & Conditions govern your use of the AK Digital website and set out the general terms on which we provide our services. By using this website or engaging our services, you agree to these terms. A specific proposal, quotation or agreement signed with you will take priority over these general terms where they differ.
1. Use of this website
- The content on this website is for general information only and may change without notice.
- You may not copy, reproduce or reuse our text, images, videos or designs without written permission.
- You agree not to misuse the website, attempt to gain unauthorised access, or submit false or harmful information through our forms.
2. Quotes and proposals
Quotes and proposals are based on the scope discussed and are valid for 30 days unless stated otherwise. Work outside the agreed scope, additional revisions or extra shoot days may be charged separately, and we will inform you before proceeding. Prices are exclusive of GST and other applicable taxes unless stated.
3. Payments
- Monthly retainers are typically billed in advance at the start of each month.
- Project work such as shoots usually requires an advance payment to confirm dates, with the balance due on or before delivery.
- Invoices are payable within the period stated on the invoice. We may pause work or withhold final deliverables if payments are overdue.
- Shoot bookings cancelled or rescheduled at short notice may attract a cancellation fee, as set out in your proposal.
4. Advertising spend
Where we manage paid advertising, ad spend is paid by the client directly to the platform, such as Meta (Facebook and Instagram) or Google, using the client's own payment method. Our fees cover management, strategy, creative and reporting, and do not include ad spend. The client remains the owner of their ad accounts, pages and Business Manager, and is responsible for complying with each platform's advertising policies. We are not responsible for platform decisions such as ad rejections, account restrictions or changes in pricing.
5. Client responsibilities and approvals
- You agree to share accurate information, brand assets and timely feedback.
- Content is published only after your approval, or under an approval process agreed in writing. Once approved, you are responsible for the content being accurate and lawful.
- You confirm that any material you provide, such as logos, product images, music or testimonials, is owned by you or used with permission.
- Delays in approvals, access or feedback may shift timelines and deliverables.
6. Content ownership and usage rights
Once full payment is received, you receive the right to use the final approved deliverables, such as edited photos, videos, designs and captions, for your business marketing, unless your proposal states otherwise. Raw footage, unedited images and project files are not included unless specifically agreed. Licensed elements such as stock media, fonts and music remain subject to their own licence terms.
AK Digital may display completed work in our portfolio, website and social media, unless you ask us in writing not to or the work is confidential. We will obtain appropriate consent before featuring identifiable individuals where required.
7. No guaranteed results
Marketing results depend on many factors outside our control, including platform algorithms, competition, market conditions, your product, pricing and sales process. While we work hard to achieve your goals, we do not guarantee specific results such as followers, reach, leads, sales or return on ad spend.
8. Confidentiality
Both parties agree to keep confidential any non-public business information shared during the engagement, except where disclosure is required by law.
9. Limitation of liability
To the maximum extent permitted by law, AK Digital is not liable for any indirect, incidental or consequential loss, including loss of profit, revenue, data or business opportunity. Our total liability for any claim relating to our services is limited to the fees paid by you for the specific service giving rise to the claim in the three months before the claim arose.
10. Termination
Either party may end a monthly engagement with the notice period stated in the proposal, or 30 days' written notice if none is stated. Fees for work completed up to the termination date remain payable.
11. Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts in Gujarat, India. We encourage both parties to first try to resolve any disagreement through good-faith discussion.
12. Changes to these terms
We may update these terms from time to time. The latest version will always be available on this page with the updated date shown at the top.
